Where is Kathleen McCormack? That’s what her family is still asking more than 30 years after her disappearance following a fight with estranged husband Robert Durst. Now, her family is suing Durst for $100 million with the claim that he murdered her and deprived them of the right to bury her body.
According to Gawker, McCormack’s 101-year-old mother Kathleen McCormack and three of her sisters filed a lawsuit in the State Supreme Court in Mineola, New York on Monday. McCormack went missing in January of 1982 after arguing on the phone with Durst and subsequently leaving a party at her friend Gilberte Najamy’s house.
“They were fighting on the phone,” Najamy said. “Kathie hung up and said, ‘I have to leave. Bobby wants me home. He’s really upset.’” On the way out, McCormack allegedly told him, “If something happens to me, you will check it out. I’m afraid of what Bobby will do.” Durst was granted a divorce in 1990 because her body was never found.
While her family is calling foul play, Durst’s team insists he is innocent. “There is no evidence that Robert Durst had anything to do with Kathleen’s disappearance,” his lawyer, Dick DeGuerin, told the New York Times. “Anybody can file a lawsuit, but eventually they’ll have to come with evidence.”
The case remains unsolved. On a side note, Durst was acquitted of murder in 2003 when prosecutors failed to present sufficient evidence to refute his claims of a struggle with Morris Black.
